Return Policy


  1. PROVISIONS FOR REFUND OF GOODS

    1. Lithuanian legal acts clearly provides that the seller of second-hand goods is not obliged to accept good quality second-hand goods purchased by the buyer, such goods may be accepted and the money returned only with the consent of the seller. Buyer has the right:
      1. to return the good quality goods within 10 (ten) days: after receiving the goods (if the goods have been delivered to the Buyer); or after withdrawal of the goods (if the Buyer has withdrawn the goods at the selling place);
      2. to return, if the goods are unsuitable quality or have defects which the Seller has not discussed with the Buyer before selling the product - within a reasonable time limit corresponded by the legal requirements, but not later than within 15 (fifteen) days from the date of receipt or withdrawal of the goods.
    2. The buyer must complete the return form on www.dalys.lt/grazinimas/grazinimas_forma in order to return the purchased goods. Having received a defective or inappropriate item, the Buyer is also obliged to contact the Seller of the product immediately; using the contacts specified in the ad and agrees in particular with the Seller on replacement of the item or refund.
    3. Qualitative goods may be changed or refunded, if the Buyer's demand for replacement or return of the goods is accepted by seller and if the product has not been used, intact, retained by its properties and has not lost its appearance, and the Buyer has evidence that he has purchased the item from this particular Seller.
    4. Goods may be considered defective and substitute to the good quality items (if available) or returned if:
      1. They do not correspond to the description given by the Seller and do not have such features as the goods presented by the Seller as an example or have defects not indicated by the Seller prior to the sale of the item;
      2. they do not correspond to quality indicators that are the usual characteristic of the same kind items and which the Buyer can reasonably expect based on the nature of the item;
      3. If the buyer a reasonable suspicion that the product was manufactured in violation of the intellectual property rights of third parties (for example, it is not original, although declared so), acquired or distributed in an unlawful way.
    5. If, at the time of conclusion of the contract, the Buyer knew or ought to have known about the non-conformity of the goods (for example, information, about defects in the product, operational defects, etc., was published in advert), then it will be considered that product is adequate quality. Proper quality used goods may be replaced or returned only with the consent of Seller.
  2. PROCEDURE FOR THE RETURN OF GOODS

    1. The defects of the sold goods are disposed of, quality and non quality goods are replaced or returned in accordance with the requirements of the Civil Code of the Republic of Lithuania; the Law on Consumer Protection of the Republic of Lithuania; and in accordance with the procedure established in the Rules for Retail Trade approved by the order of the Government of the Republic of Lithuania on the 22 July 2014.
    2. Upon returning the goods, the buyer must comply with the following conditions:
      1. Returned Goods must be in a well-ordered package (this requirement does not apply to the return of defective goods);
      2. The Product returned by Buyer must be in good condition;
      3. The returned Product must be the same as the one received by the Buyer;
      4. The product must be not used; it has to be original appearance (labels without damaged, unbreakable protective films, etc.). This item does not apply in the case of a defective product being returned.
    3. If the goods are returned directly to the Seller, together with the returned goods, it is necessary to submit its purchase document and the information submitted by the Seller regarding the return of the goods (if it was issued). If the item is returned through courier, the sticker of the batch, printed from Dalys.lt must be affixed on the packaging of the product.
    4. If the Buyer does not comply with the above-specified procedure for the return of goods, the Seller has the right not to accept the goods returned by the Buyer, but this provision does not restrict the Buyer's right to protect his rights if the item of inappropriate quality has been sold.
    5. Upon agreement of all return conditions by the Buyer with the Seller, the Goods are exchanged or returned in two ways: via courier or at one of the Seller's trading places. The Buyer submits to the Seller a written request, indicating the defects of the Product (if the product is inadequate), the reason for the return and the purchase-sale of the item confirmation document received from the Seller.
  3. EXPENDITURE EXPENSES OF THE RETURNED GOODS

    1. If returning defective goods or the goods, which do not conform to the description of the advertisement, or the goods that were different from the advertisement- expenditure expenses are covered by the Seller.
    2. If the item is returned due to the Buyers fault, the costs of the sending are covered by the Buyer.
  4. MONEY RETURN PROCEDURE

    1. In the Goods Refund Form, along with other specified information, the Buyer shall indicate the bank account number to which the money paid for the goods must be returned.
    2. Upon agreement of all conditions of the Return of Goods by the Buyer and the Seller, the money will be transferred to the specified bank account within 14 (fourteen) days from the day the Seller has received the item.
  5. SERVICE PROVIDER'S OBLIGATIONS

    1. If the Seller and the Buyer disagree about the return of the Goods and refund of the money within 10 (ten) working days from the date of the Buyer's request to change or return the item, the Buyer has the right to apply to the Service Provider, indicating all the circumstances of the dispute. The Service Provider, in accordance with the provisions of the Terms of Use, commits to take a decision within 5 (five) business days.
    2. If the Service Provider makes a decision in favor of the Buyer, the Service Provider, within 5 (five) business days from the date of the decision, transfer to the Buyer’s bank account the money paid for the item, indicated by the Buyer on the return form of the goods.
